Terms of Service
We allow you access to our website RequestDelivery.net, through which we offer a service (a Request) for placing your online orders with our independent drivers that provide delivery services for food, beverages, groceries, and any other products from restaurants and merchants. The term ‘You’ refers to the end user of the Request service.
Please be sure to read these Terms of Service. They help the process with your access with our service.
If you do not agree to these Terms you should not use the website or Request.
3. About us: We are not a courier service or logistics provider.
Request Delivery Services LP. Provides technology services for connecting people who want to place on demand requests (“Customers”) from restaurants, merchants, grocery stores ("Merchants") with our drivers who wish to provide delivery services to fulfil those requests. By accepting these terms, you accept that we are not a courier or logistics service. We also do not supply the food or groceries or any of the products delivered to you. Also, the drivers who deliver your items are not employees or representatives. The drivers are independent contractors that provide the delivery services for the Customers and merchants.
4. Customer Terms
As the customer of Request you are responsible for all fees, taxes, and prices associated with your delivery order. By accepting these terms, you also agree to comply with all laws at all times.
You also acknowledge that the drivers who process your delivery for Request, is an independent contractor, and that Request has no responsibility or guarantee (1) regarding the drivers and their vehicles, or (2) the Merchants or the quality of their products delivered by the drivers. You also accept that Request retains a portion of each delivery fee. You accept all the risks related to interacting with the drivers and the Merchants and also all risks associated with the products delivered to you by the driver.
You also agree to be respectful to your driver. If you have any problems with your driver or your delivery you will communicate your problem to us at RequestServices@outlook.com.
You also agree that all orders placed by you must follow all local laws and regulations.
5. The Delivery Process
Once a request has been submitted, Request will notify the next available driver and relay them certain information that is necessary in order to complete the delivery. This may include your full name, address, phone number and your request. These are all necessary for your delivery to be completed by the driver. The driver then places your order with the appropriate Merchant. The driver will pay for the food and then deliver the order to you. Orders can be modified if the Merchant does not have the exact item but the driver will try and keep you updated through text messages. You agree that the only communication you can have with your driver has to be directly related to the current delivery. If you have any other questions you can always contact us at RequestServices@outlook.com. The driver and the Merchant are responsible for the delivery fulfillment, not Request.
6. The Payment Process
You agree to pay all prices including any fees or taxes associated with your order. The Merchants set their own prices. Request does not adjust the Merchants price in any way. When you are paying for your order you are being charged for: (a) the total amount of each and every purchase you ordered. (This amount cannot be communicated with you until the transaction between the Driver and the Merchant has happened) (b) The delivery fee which varies by area, (c) a 10% Service fee (The service fee appears as 'Tax' on your PayPal receipt) and (d) any additional tip you would like to give your driver. There are times in which we will offer discounts or special coupon codes. You hereby authorize your payment method to be charged for the fees associated with each order you place either by using our website, phone or text message.
Tipping – After a driver has completed a delivery and the payment process is happening, there will be an option for tipping your driver.
Taxes- The Customer is agreeing that they are responsible for paying all sales or comparable taxes associated with the order that was placed using our Services.
Split-Pay - With split paying there will be a $3 fee for each separate order.
Peak Hour Pricing- On Fridays and Saturdays from 6:30-9:30 pm the delivery fee will $8 instead of the normal $6.
7. Interactions with the driver
We are not responsible for the interactions between the driver, the Customer and the Merchants. You are responsible for your interactions with your driver and you also agree to look solely at the driver or the Merchant for any claim, damage or liability associated with any transaction commissioned by the Request services or any order AND EXPRESSLY WAIVE AND RELEASE REQUEST FROM ANY AND ALL CLAIMS, DAMAGES AND LIABILITIES ARISING OUT OF ANY ACT OR OMISSION OF ANY DRIVER OR MERCHANT, INCLUDING WITHOUT LIMITATION DAMAGES RELATING TO PERSONAL INJURY OR DESTRUCTION OF PROPERTY.
Request and certain third parties (Drivers) will need to communicate with you about the Request services including delivery requests. By agreeing you consent to receive messages either through phone, text, or email from Request or any of our third parties (drivers) and acknowledge that your phone number, email address, and other information may be used for the purpose of delivering your order.
9. Limitations to our service
Request is not available at all times, in all languages or in all geographical locations. There is no guarantee that a request will be made at a certain time. Unforeseeable circumstances may delay or even cancel your order. We do not deliver to every area in the cities we are available in. In some cases we may only deliver to certain neighborhoods. Our delivery may change throughout the year depending on driver availability. We also cannot guarantee that the Merchant will let us complete your order. You use Request at your own risk and you must follow any laws that applicable to your area. The use of Request is void where prohibited. Internet delays or lack of phone signal may also occur and Request is not responsible for any delays, delivery failures, or any other damages resulting from such problems.
11. Relationship between driver and Request
If you are driver, you are an independent contractor and you are not an employee, owner, joint venturer, partner or agent of the Company and that there is no employment agreement between you and the Company. In addition, if you are a driver, you further understand and agree that you have no authority to bind the Company and you will not make any representations to any party that you have any authority to bind the Company, as an employee, partner or otherwise.
12. Changes to Terms of Service
We may change the terms of this Agreement from time to time. Any change will be effective when we notify you of the change (via an update through the Request service) and you signify your acceptance (By clicking 'Submit' on your next delivery).
